This bill amends Tennessee law to create new liability provisions for charitable organizations that provide housing to individuals known to be unlawfully present in the United States. Specifically, the bill allows such organizations to be held legally responsible for losses, damages, injuries, or deaths resulting from criminal offenses committed by these individuals while receiving housing services, but only if the charitable organization's conduct in providing housing can be proven to constitute negligence, gross negligence, or willful and wanton misconduct. The bill defines "housing" as long-term living accommodations, which includes helping someone obtain or sign a lease for an apartment or rental home, but explicitly excludes temporary overnight housing like homeless shelter services. This legislation appears designed to create legal accountability for charitable organizations that knowingly provide housing to undocumented immigrants, by establishing a standard under which they could be sued for damages if a criminal act occurs. The bill will take effect immediately upon becoming law, as determined by the Tennessee General Assembly.
