This bill amends Idaho Code Section 49-613 to strengthen regulations around vehicle load security and spillage prevention. The bill maintains existing prohibitions on depositing harmful materials on highways and expands provisions requiring vehicles to secure their loads to prevent materials from becoming loose or hazardous to other highway users. Specifically, the bill mandates that vehicles transporting dirt, sand, or gravel on paved highways must be covered to prevent spillage, removing a previous exception that allowed loads with six inches of freeboard. The legislation introduces a fixed $200 penalty for drivers found in violation of the spillage prevention rules. Additionally, the bill requires the Idaho Transportation Department to notify law enforcement agencies and, in collaboration with the Idaho Trucking Association, provide educational materials to the trucking industry about the new load security requirements by October 1, 2025. Certain exemptions remain for government vehicles performing maintenance, vehicles owned by irrigation districts, and those transporting unprocessed agricultural products. The bill is declared an emergency, meaning it will take effect immediately upon passage and approval.
