This bill amends the Illinois Vehicle Code to modify the definition of aggravated fleeing or attempting to elude a peace officer by establishing specific criminal penalties based on the severity of harm caused during the offense. Under the proposed changes, a person who flees from a peace officer after receiving a visual or audible signal can be charged with aggravated fleeing if their actions meet certain criteria, such as driving at least 21 miles per hour over the speed limit, causing bodily injury to an individual, causing property damage over $300, disobeying multiple traffic control devices, or concealing or altering the vehicle's registration plate. The bill introduces graduated felony charges depending on the extent of injury: a Class 3 felony if a bystander or member of the public is injured, a Class 2 felony if the pursuing peace officer is injured, and a Class 1 felony if the pursuing peace officer suffers great bodily injury or becomes disabled. These provisions aim to deter dangerous vehicle evasion and protect both the public and law enforcement officers by imposing more severe criminal penalties for increasingly harmful actions during a police pursuit.
