Under the proposed changes, when a claimant (the person seeking compensation) enters into a release or similar agreement with one liable party, that agreement will discharge the specific party from liability but will not automatically discharge other potentially responsible parties. The claimant's claim against other liable parties will be reduced by the amount of the released party's share of obligation, as determined by the court or jury. Importantly, the bill clarifies that such an agreement does not abrogate (cancel or eliminate) the joint and several liability of other parties who might be responsible for the same claim. This means that even if one party is released, other parties can still be held accountable for their portion of the damages. The bill essentially preserves the ability of a claimant to seek full compensation from multiple parties while preventing double recovery.
