This bill establishes mandatory education requirements for members of homeowners' association (HOA) management committees and boards, aiming to improve the knowledge and effectiveness of community leaders. The bill requires each management committee or board member to complete one hour of education annually, covering topics such as relevant statutes, governing documents, fiduciary duties, ethics, leadership, meeting procedures, financial responsibilities, maintenance, risk management, member roles, conflict resolution, and reserve analysis. Members must complete their first hour of education within 90 days of starting their service and then annually thereafter. The association must maintain up-to-date records of each member's education compliance and make these records available to unit or lot owners upon request. If a member fails to complete the required education, unit or lot owners can take legal action, which may include seeking injunctive relief, removal of the non-compliant member, and potential monetary penalties. Additionally, the bill requires education providers to submit statements to the Department of Commerce attesting to their training offerings and ensures the Department maintains a public list of these providers. The new requirements will take effect after the period of administrative control ends, with a final implementation date of July 1, 2026.
