This bill creates the Data Center Construction by Foreign Adversaries Act, which prohibits foreign companies from constructing data centers in Illinois without first undergoing a comprehensive energy assessment. Specifically, before a data center can be built, the Illinois Commerce Commission, Illinois Power Agency, and Department of Commerce and Economic Opportunity must conduct a joint study of the proposed data center's energy consumption. These agencies must then certify to the Governor and General Assembly that the data center's energy use will be a "self-generated load" and will not impact the electricity supply of PJM (PJM Interconnection, a regional transmission organization) or MISO (Midcontinent Independent System Operator, another regional electricity transmission organization). The bill defines a "foreign company" as an entity that is at least 51% owned by a foreign adversary or is headquartered in a country with a government considered a foreign adversary. The purpose of the bill appears to be to prevent potential national security risks and ensure that new data center construction does not disrupt the state's existing energy infrastructure.
