Bill Summary

AN ACT to amend the education law and the public health law, in relation to authorizing pharmacists to administer injections for contraceptive use

AI Summary

This bill expands the role of pharmacists in providing contraceptive services by authorizing them to administer United States Food and Drug Administration (FDA) approved reversible progestin-only contraceptive injections. Under this legislation, pharmacists can now execute non-patient specific orders to administer these injections, similar to their existing ability to dispense self-administered hormonal contraceptives. Before administering the injection, pharmacists must provide patients with a self-screening risk assessment questionnaire and a fact sheet developed by the health commissioner, covering clinical considerations, usage instructions, and healthcare referral information. Pharmacists must also complete specific training and, within 72 hours of administration, notify the patient's primary healthcare practitioner (unless the patient opts out). The bill includes protections that allow pharmacists to refuse administration if they believe potential adverse effects could endanger the patient's health. Physicians and certified nurse practitioners can prescribe these non-patient specific orders, and the bill defines the specific type of contraceptive injection covered. The legislation will take effect one year after becoming law, with immediate authorization for developing necessary implementation regulations.
