AN ACT To amend an Act to provide a homestead exemption from Troup County school district ad valorem taxes for educational purposes in the amount of $10,000.00 of the assessed value of the homestead for certain residents of that school district who have annual incomes not exceeding $22,000.00 and who are 65 years of age or over, approved March 24, 1994 (Ga. L. 1994, p. 3844), as amended; so as to increase the existing homestead exemption; to increase the income cap; to provide for compliance with constitutional requirements; to provide for a referendum, effective dates, automatic repeal, mandatory execution of election, and judicial remedies regarding failure to comply; to provide for related matters; to repeal conflicting laws; and for other purposes.
AI Summary
This bill proposes to increase a property tax homestead exemption for seniors in the Troup County school district, specifically expanding the existing tax break for residents aged 65 and older. The bill would raise the homestead exemption from $40,000 to $100,000 of the assessed property value and increase the income cap from $40,000 to $50,000 for qualifying residents. To implement these changes, the bill requires a referendum election to be held on the Tuesday after the first Monday in November 2025, where Troup County voters will decide whether to approve the new tax exemption. The ballot will clearly state the proposed changes, and if more than half of the voters approve, the new exemption will take effect on January 1, 2026. If the referendum fails or the election is not properly conducted, the bill will be automatically repealed. The bill also includes provisions ensuring that if the election superintendent does not properly conduct the election, any local voter can seek a court-mandated remedy to compel compliance. Additionally, the bill must receive a two-thirds majority vote in both the Georgia Senate and House of Representatives to become law.
