Bill Summary

AN ACT To amend Chapter 80 of Title 36 of the Official Code of Georgia Annotated, relating to general provisions applicable to counties, municipal corporations, and other governmental entities, so as to waive sovereign and governmental immunities for local governments and their officials and employees for a violation of the prohibition on immigration sanctuary policies; to amend Code Section 42-1-11.5 of the Official Code of Georgia Annotated, relating to compliance with immigration detainer notices, so as to provide for immunity waivers; to provide for related matters; to repeal conflicting laws; and for other purposes.

AI Summary

This bill modifies existing Georgia state law to remove sovereign and governmental immunity for local governments, officials, and employees who fail to comply with immigration-related regulations. Specifically, the bill adds provisions that waive immunity if a local governing body or custodial authority (such as a sheriff, police chief, or warden) does not follow immigration detainer notices or sanctuary policy prohibitions. An immigration detainer notice is a federal government document requesting that a local authority maintain temporary custody of an individual identified as an illegal alien. Under this bill, if a local government entity or official fails to comply with these requirements, they can now be sued or held legally accountable, whereas previously they would have been protected by sovereign immunity. The bill aims to strengthen enforcement of immigration-related policies by removing legal protections that could previously shield local governments from consequences for non-compliance with federal immigration requests.
