AI Summary
This bill strengthens legal protections and procedures for domestic violence cases in Mississippi by modifying three key sections of the state's legal code. Specifically, the bill requires judges to impose a mandatory holding period of at least 24 and not more than 48 hours when setting bail for domestic violence offenses, ensuring that defendants cannot be immediately released. The legislation also mandates that courts require defendants charged with domestic violence to wear a Global Positioning Monitoring System (GPS) device, which tracks their location and cannot be removed without court approval. The GPS device must be installed before the defendant is released from jail, and the monitoring entity must notify the court and local law enforcement if the defendant violates bond conditions. Additionally, the bill requires courts to consider the victim's input when setting locations from which the defendant must stay away, and provides comprehensive information to victims about their rights, the monitoring system's capabilities, and available support services. The changes aim to enhance victim safety by creating stricter monitoring and restrictions for domestic violence defendants, while also providing more robust protections and information for potential victims. The bill will take effect on July 1, 2025, giving local courts and law enforcement time to prepare for the new requirements.
