This bill amends North Dakota law to establish and formalize a family paid caregiver service pilot project managed by the Department of Health and Human Services. The project will provide payments to legally responsible individuals (such as family members) who provide extraordinary care to eligible Medicaid waiver participants, excluding the aged and disabled waiver. "Extraordinary care" is defined as care that goes beyond typical household responsibilities and is necessary to ensure the health and welfare of the care recipient and prevent institutionalization. The department will adopt rules to manage the project, determine eligibility, and assess the need for extraordinary care based on factors like age, daily living activities, medical needs, and social-emotional needs. Payments will be commensurate with rates in the home and community-based services aged and disabled waiver, and cannot duplicate other compensated services. The cross-disability advisory council will provide feedback on the project's planning and implementation. The bill also appropriates $7.3 million from the general fund to support the pilot project during the 2025-2027 biennium. Legally responsible individuals must annually attest that they will not seek reimbursement on days when other waiver services are paid, and decisions about the project can be appealed, though funding limitations may restrict such appeals.
