Bill Summary

Reinserts the provisions of the introduced bill with the following changes. Makes it a non-exclusive easement. Provides that the conveyance of the authorized easement is made subject to: (1) existing public utilities, existing public roads, and any and all reservations, easements, encumbrances, covenants and restrictions of record; (2) the entering into of a shared maintenance agreement for the land subject to the easement between the Department of Natural Resources and KSS Conservation Partners, LLC; and (3) the express condition that if either the Department of Natural Resources or KSS Conservation Partners, LLC ceases to have a shared maintenance agreement for the land that is the subject of the easement, the easement automatically terminates and the land fully reverts to the State of Illinois, Department of Natural Resources. Effective immediately.

AI Summary

This bill authorizes the Director of the Department of Natural Resources (DNR) to convey a non-exclusive, 20-foot wide ingress-egress easement to KSS Conservation Partners, LLC for access to Senate Island in Fulton County, Illinois, for a nominal fee of $1.00. The easement follows a specific centerline description that connects Senate Island to the public right-of-way of Banner Dike Road through two detailed segments. The conveyance is subject to three key conditions: (1) the easement remains subject to existing public utilities, roads, and recorded restrictions, (2) DNR and KSS Conservation Partners must enter into a shared maintenance agreement for the land, and (3) if either party terminates the shared maintenance agreement, the easement automatically terminates and the land fully reverts to the State of Illinois. The bill requires the Director of DNR to obtain a certified copy of the Act and record it in the Fulton County Recorder's Office only after the shared maintenance agreement is established, and it takes effect immediately upon becoming law.
