This bill requires all persons in a city with a population of one million or more to wear a helmet while operating a bicycle, electric bicycle, or electric scooter on public highways, private roads open to motor vehicle traffic, or in parks. The helmet must meet specific safety standards set by organizations like the American National Standards Institute (ANSI), Snell Memorial Foundation, American Society of Testing and Materials (ASTM), Safety Equipment Institute, and the U.S. Consumer Product Safety Commission. Violations are considered a traffic infraction punishable by a civil penalty of up to $50. For individuals under 16 years old, the penalty can be waived if the parent or guardian purchases a helmet or can demonstrate economic hardship. Parents or guardians of children under 16 can be held liable for violations, but only if the violation occurs in their presence and they are 18 or older. Importantly, failure to wear a helmet cannot be used to reduce damages in personal injury or wrongful death lawsuits. The bill will take effect 90 days after becoming law, and appears to be specifically targeted at large cities like New York City.
