This bill establishes the Employee Misclassification Working Group to improve coordination between state agencies in addressing the issue of employee misclassification, which occurs when employers incorrectly classify workers as independent contractors instead of employees. The bill allows the Department of Revenue to share state tax information with various offices within the Department of Labor and Industry, including the Bureau of Workers' Compensation and the Office of Unemployment Compensation Services, to help investigate potential misclassification. The working group will be composed of representatives from the Department of Labor and Industry, Department of Revenue, and the Office of Attorney General, with the option for county district attorneys and local labor law enforcement to participate. A representative designated by the Secretary of Labor and Industry will serve as the chairperson, who can invite additional participants and will oversee meetings that will occur at least quarterly. The bill aims to streamline information sharing and compliance efforts across agencies to more effectively identify and address employee misclassification. The act will take effect 60 days after its passage.
