This bill amends the New York Civil Practice Law and Rules to allow for the enforcement of a money judgment against certain trust accounts, custodial accounts, annuities, insurance contracts, and other financial assets when the judgment is related to sexual abuse of a minor. Specifically, the bill permits these financial resources to be used to satisfy a civil judgment for victims who were minors at the time they experienced specific serious sexual offenses, including rape in the first degree, aggravated sexual abuse in the first degree, or course of sexual conduct against a child in the first degree, as defined in the New York Penal Law. Prior to this amendment, such trust and financial accounts were generally exempt from being used to satisfy a money judgment. The new provision creates an exception to the existing protection of trust assets, allowing victims of serious sexual crimes committed against them as minors to potentially access financial resources held in trust by the perpetrator as part of their legal remedy. The bill takes effect immediately upon enactment.
