This bill establishes the Agricultural Emissions Right to Repair Act, which requires original equipment manufacturers (OEMs) of agricultural equipment to provide independent repair providers and equipment owners with access to documentation, parts, tools, and embedded software needed to diagnose, maintain, and repair emissions systems. The bill defines key terms such as agricultural equipment (which includes machinery used in agriculture, horticulture, livestock raising, and other related fields, but excludes motor vehicles), and sets standards for what constitutes "fair and reasonable terms" for providing these repair resources. OEMs are prohibited from using parts pairing or other technological mechanisms to prevent the installation of non-manufacturer parts, inhibit equipment functionality, create misleading warnings, or limit who can purchase repair materials. The legislation mandates that manufacturers make available all necessary documentation, parts, and tools either directly or through authorized repair providers, while protecting trade secrets and maintaining certain safety provisions. Violations of the act will be treated as unfair trade practices, with penalties outlined in existing state law. The bill is set to become effective on April 1, 2026, and will apply retroactively to equipment manufactured on or after July 1, 2015, giving farmers and independent repair shops more control and flexibility in maintaining their agricultural equipment's emissions systems.
