This bill provides a new legal procedure for police officers who believe their rights have been denied during a disciplinary process. Specifically, the bill allows a police officer to apply to the appropriate circuit court for an "order to show cause" before a hearing board proceeding takes place. The court application depends on the type of law enforcement agency the officer works for: if the officer is employed by a county or local agency, they would apply to the circuit court in the county where the agency is located; if the officer works for a statewide or multi-county agency, they would apply to the Circuit Court for Anne Arundel County. The purpose of this order is to require the law enforcement agency to explain why the officer's claimed right should not be granted. This new provision gives police officers an additional legal mechanism to challenge potential rights violations during the disciplinary process. The bill is set to take effect on October 1, 2025, providing agencies and officers time to prepare for the new legal option.
