This bill amends the Mississippi Motor Vehicle Commission Law to prohibit motor vehicle dealers, salesmen, manufacturers, and franchisors from sharing customer lists or personal information with third parties, with some specific exceptions. The bill allows sharing of customer information only under limited circumstances, such as when necessary for selling or delivering a new vehicle, validating consumer or dealer incentives, conducting reasonable marketing, evaluating dealer performance, performing analytics, or submitting information to a franchisor for warranty-related services. Importantly, the law does not prevent sharing customer information to meet safety recall notices or other legal obligations. The new provisions apply to both motor vehicle dealers and manufacturers, creating a uniform standard for protecting customer data. Dealers and manufacturers are still permitted to use customer information internally and for specific, narrowly defined business purposes. The bill will go into effect on July 1, 2025, giving businesses time to adjust their data-sharing practices to comply with the new restrictions.
