This bill amends the New York General Business Law by establishing new provisions to prevent price gouging for food and food products. The legislation defines "food and food products" broadly to include all edible items for humans and animals, and applies to every party in the distribution chain, from manufacturers to retailers. The bill empowers courts to determine whether a price is "unconscionably excessive" based on factors such as extreme price increases, unfair leverage, or a combination of both. To prove a violation, evidence must show a gross disparity between the current price and the seller's typical pricing or a significant deviation from market rates. Defendants can defend against allegations by demonstrating that the price increase maintains their usual profit margin or results from unavoidable cost increases. The Attorney General is authorized to seek court injunctions against violators and can impose substantial civil penalties of up to $25,000 per violation or three times the gross receipts, whichever is greater. Additionally, the Attorney General may order restitution for affected consumers and is granted the power to create rules and regulations to enforce these provisions. The act takes effect immediately upon passage.
