This bill amends the existing Idaho law regarding how state agencies can contract with state institutions of higher education. Currently, agencies are prohibited from entering into noncompetitive contracts with these institutions unless specifically authorized. The bill introduces a new process where an agency seeking to contract with a higher education institution must first determine which institutions are interested in competing. If more than one institution expresses interest, the agency must then seek quotes or proposals and award the contract to the institution that provides the best offer based on cost and other relevant criteria. The bill defines "state institutions of higher education" as Boise State University, Idaho State University, Lewis-Clark State College, and the University of Idaho, and clarifies that these provisions do not apply to surplus property procurements. The changes aim to create a more transparent and competitive process for interagency contracts with higher education institutions, ensuring that agencies select the most advantageous proposal while giving all eligible institutions a fair opportunity to compete. The bill will go into effect on July 1, 2025, and is being implemented with an emergency declaration.
