This bill amends Pennsylvania's Medical Marijuana Act to allow qualified medical marijuana patients who are 21 years or older and have been state residents for at least 30 days to cultivate cannabis for personal use, with specific regulatory guidelines. Patients may grow up to six cannabis plants in any growth stage, but must keep them in an enclosed and locked space that is not visible to the public and secure from unauthorized access, particularly by individuals under 21. Cultivation is only permitted on residential property the patient lawfully possesses or with the property owner's consent, and property owners can prohibit cannabis cultivation by lessees. Plants may only be tended to by the patient, their authorized agent, or their caregiver if the patient is physically unable to manage the plants. Patients are prohibited from selling or giving away the cannabis plants, cannabis, or cannabis-infused products produced under this provision, and doing so would result in penalties and loss of home cultivation privileges. Additionally, patients can purchase cannabis seeds exclusively from dispensaries, but cannot redistribute those seeds to others. The bill will take effect 60 days after its passage.
