This bill modifies the existing law regarding public school transfers within a school district, making it easier for parents to transfer their children to other schools. Under the new provisions, parents can apply to the district superintendent to transfer their child to another public school, public academy, or approved private school within the same district, with the primary consideration being whether the requested school has the capacity to accommodate the student. For transfers within the district, parents must generally apply by July 1 for the upcoming school year, and the superintendent will primarily evaluate the school's ability to accept the student based on teacher-to-student ratio and existing capacity. For transfers outside the district, parents can still request a transfer, and the superintendent will consider the student's academic, physical, personal, or social needs. If a transfer is approved, the superintendents will jointly establish a tuition rate, which may be partially or fully waived. Transportation remains the responsibility of the parent or guardian. The bill also requires school districts to adopt policies for managing transfer requests when school capacity is limited. The new law is set to take effect on July 1, 2025, and aims to provide parents with more flexibility in choosing schools within their district.
