This bill creates a new appeals process for licensed firearms manufacturers, importers, and dealers to challenge Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) rulings or determinations. Under the new procedures, when a licensee submits a written request for clarification on a regulatory matter, the Attorney General must provide a written ruling within 90 days. The licensee can then appeal the ruling through a multi-step process: first, by requesting a review from a Director of Industry Operations within 30 days, who must respond within 30 days; and second, by requesting a hearing before an administrative law judge within 75 days of the initial ruling or 14 days after the Director's determination. The administrative law judge must hold a hearing within 90 days and issue a decision within 90 days after the hearing. The decision becomes a final agency action subject to judicial review and is binding on both the United States and the licensee. Importantly, submitting an administrative appeal will postpone the effective date of the ruling until the entire appeals process, including potential judicial review, is complete. The bill applies to determinations made before, on, or after the date of enactment, providing a comprehensive new framework for challenging ATF rulings.
