This bill adds a new section to the Texas Water Code that restricts groundwater permits for certain foreign individuals and entities from designated countries deemed to pose a national security risk. Specifically, groundwater conservation districts are prohibited from issuing, amending, or renewing permits for governmental entities, organizations, or individuals from these countries if doing so would create a risk to public health, safety, and welfare. The bill defines "designated countries" as those identified in the U.S. Intelligence Community's Annual Threat Assessments as national security threats. It also provides detailed definitions of organizational control, including how control can be established through voting interests, financial arrangements, or other means of directing an organization's activities. The bill does not apply to U.S. citizens, lawful permanent residents, or organizations owned by such individuals. The new provisions will take effect on September 1, 2025, and will only apply to permits issued, amended, or renewed on or after that date, with existing permits remaining under previous legal standards.
