This bill modifies the Public School Code of 1949, specifically addressing the powers and duties of intermediate unit (IU) boards of directors and their capital subsidy provisions. The bill expands the IU board's ability to acquire land and buildings by allowing them to acquire property through purchase, lease, or gift, instead of just leasing. It also updates the capital subsidy process by requiring the Secretary of Education to pre-approve a broader range of financial agreements, including loan agreements and mortgages, in addition to existing lease and security agreements. The capital subsidy calculation remains unchanged, continuing to be based on a formula that multiplies the number of students in average daily membership (ADM) by the median actual instruction expense and a factor of 0.03%. These changes aim to provide intermediate units with more flexibility in acquiring and financing office, classroom, and warehouse facilities while maintaining oversight through mandatory pre-approval from the Secretary of Education. The bill takes effect immediately upon enactment.
