This bill prohibits the use of glyphosate and neonicotinoid pesticides in Missouri, starting January 1, 2026. Specifically, the bill defines neonicotinoid pesticides as any pesticides containing chemicals in the neonicotinoid class, as determined by the U.S. Environmental Protection Agency. The Missouri Department of Agriculture will be responsible for enforcing this prohibition, with the power to assess civil penalties up to $10,000 for each violation. If a person violates the ban in two consecutive years or two of the last three years, they will be considered a chronic violator and may face penalties up to $25,000. Existing stocks of these pesticides purchased before the start date are exempt from the ban. The department can also investigate violations, with investigation costs recoverable from the violator, and any collected penalties will be remitted to the local school district. Additionally, the department can deny, suspend, revoke, or modify licenses or permits for individuals who violate this prohibition. The bill allows the department to create rules for implementation, with provisions ensuring that any new rules comply with state administrative procedures.
