Bill Summary

AN ACT to amend the labor law, in relation to collective bargaining rights to farm laborers; to amend the public health law, in relation to the application of the sanitary code to all farm and food processing labor camps for migrant workers; to amend the workers' compensation law in relation to the eligibility of farm laborers for workers' compensation benefits and in relation to service as farm laborers; to amend the labor law, in relation to labor on a farm; to repeal sections 1, 2, 24 and 25 of chapter 105 of the laws of 2019 relating to farm laborers; and repealing certain provisions of the labor law and the workers' compensation law relating thereto

AI Summary

This bill modifies several existing laws related to farm laborers' rights and employment, effectively rolling back some previously established protections. The bill repeals key sections of prior legislation (Chapter 105 of the Laws of 2019) that had expanded collective bargaining and labor rights for farm workers. Specifically, the bill removes farm laborers from certain employment definitions, excludes them from minimum wage and overtime regulations, and eliminates provisions that previously gave farm workers more comprehensive labor protections. The bill changes how farm laborers are classified for purposes of workers' compensation, unemployment insurance, and labor laws, essentially returning them to a status with fewer workplace rights compared to other types of workers. Notable changes include removing farm laborers from the definition of "employees" in various labor law contexts, repealing provisions about agricultural labor crew leaders, and modifying requirements for farm labor camps and workers' compensation coverage. The bill effectively reverses many of the progressive labor protections for farm workers that were implemented in 2019, reducing their legal standing in areas such as collective bargaining, minimum wage, and workplace safety regulations.
