Bill Summary

AN ACT to amend the public health law, in relation to requiring reporting of positive cytomegalovirus test results

AI Summary

This bill requires local health departments to take specific actions when a newborn tests positive for cytomegalovirus (CMV), a viral infection that can cause serious health problems in infants. Upon receiving a positive test result through the electronic clinical laboratories reporting system, the local health department must immediately contact the newborn's pediatrician, or if unavailable, the chief of newborn services or medical director at the hospital where the infant was born. The department must also contact the parents to inform them of the positive result. If the initial positive test comes from a saliva specimen, a confirmatory polymerase chain reaction (PCR) urine test must be administered within three weeks of the infant's birth. If the urine test confirms the positive result, the health department must again notify medical professionals and ensure the parents are referred to a pediatric infectious disease specialist within one week. The specialist must conduct a comprehensive examination before the infant reaches four weeks of age, including head circumference measurement, head sonogram, blood tests, eye exam, and hearing evaluation. The bill also instructs the health commissioner to add CMV to the list of communicable diseases and defines a "newborn" as an infant 31 days old or younger. The act will take effect immediately upon passage.
