Bill Summary
AN ACT to amend the transportation corporations law, in relation to the construction of new pipe lines
AI Summary
This bill amends the transportation corporations law to modify the requirements for constructing new pipe lines in villages, towns, and cities in New York State. Currently, pipe lines can only be constructed with authorization from local governing bodies through a resolution passed by a two-thirds vote, which specifies the route, construction manner, and terms of the pipeline. The bill expands this requirement to explicitly include towns, in addition to villages and cities, and adds the word "new" before "pipe line" to clarify that the provision applies specifically to new pipeline construction. The bill also maintains existing provisions about pavement removal, which require pipeline corporations to obtain authorization from the legislative body and provide a bond to ensure proper relaying of any removed pavements. Additionally, the bill preserves language protecting private property rights and allows cities to sue corporations that fail to properly relay pavements. The legislation will take effect immediately upon passage.
