This bill establishes a new review process for denials of eligibility for long-term services and supports in Minnesota. The bill requires lead agencies to provide at least ten calendar days' notice before taking any action to deny, reduce, suspend, or terminate access to various medical and social services, including home and community-based waiver services, personal care assistance, consumer support grants, and case management services for vulnerable populations. When an agency intends to take such action, it must give the person or their legal representative an opportunity to respond and request a decision review. If a review is requested, the agency must schedule a conference within five days, allowing for interactive communication in an accessible format, such as a phone call, meeting, or written exchange. During this review, the agency must thoroughly explain its decision and allow the person to ask questions or provide additional clarifying information. If the person has a representative, they are not required to participate, and they may choose to have someone of their choosing attend. Importantly, the person will continue to receive their current services during the review process. After the review, the agency may issue a written notice of action, which must be in English and include a language assistance block. The bill does not affect existing appeal rights under state law.
