AI Summary
This bill requires the Mississippi Department of Mental Health (DMH) to develop and implement a comprehensive performance assessment system for community mental health centers. By June 30, 2026, the department must create a rating scale with specific performance standards that will be used to conduct performance audits of community mental health centers, with these audits beginning in fiscal year 2027. The department will be required to audit each community mental health center at least once every two years. If a center fails its performance audit, it will be given a six-month probationary period to improve. If the center does not achieve a passing score after this period, the regional commission must replace the center's executive director and other specified officers with contractors selected by the department. These contractors will have full authority to operate the center and will remain in place until the department determines the center has achieved sustained compliance with performance standards. The bill also exempts the Department of Mental Health from certain public procurement review requirements when implementing these performance audit procedures, and explicitly states that no rules or standards created under this bill can be used to create a legal cause of action.
