This bill establishes the Mississippi Kratom Consumer Protection Act, which regulates the preparation, distribution, and sale of kratom products in the state. The act defines kratom products as food items containing leaves or extracts from the Mitragyna species plant, such as powders, capsules, or beverages. The bill prohibits processors and retailers from selling kratom products that are adulterated or contaminated with dangerous non-kratom substances, contain more than 2% 7-hydroxymitragynine in the alkaloid fraction, include synthetic alkaloids, or lack adequate labeling with recommended serving sizes. Additionally, the law restricts sales to individuals 21 years of age or older and imposes administrative fines for violations, ranging from $1,000 for the first offense to $5,000 for subsequent offenses. The Mississippi Department of Health is authorized to administer and enforce the act, with the power to develop necessary rules and regulations. Retailers can avoid penalties if they can prove they relied in good faith on representations from manufacturers or distributors. The bill will take effect on July 1, 2025, providing time for businesses and regulators to prepare for the new requirements.
