This bill establishes new restrictions on how cities and code cities (a specific type of municipal government in Washington) can designate historic landmarks. Under the bill, cities cannot designate a property as a historic landmark if the property is less than 40 years old, or if the designation would restrict the property's use, alteration, or demolition without the written consent of the property owner. If such a designation is made without the owner's consent after the bill's effective date, it is automatically void. The bill provides two key exceptions to these restrictions: first, properties within an already established historic district are exempt, and second, properties that are more than 125 years old can be designated as historic landmarks even without the owner's consent. Cities and code cities must update their development regulations, zoning regulations, and preservation ordinances to comply with these new requirements within one year of the bill's effective date. If they fail to do so, the bill's provisions will automatically supersede and invalidate any conflicting local regulations. The bill applies to properties zoned for residential or mixed use and aims to balance historic preservation efforts with property owners' rights.
