This bill amends Arkansas law to authorize third-party delivery of alcoholic beverages from certain retailers by creating a new third-party delivery permit system. The bill expands the types of retailers who can deliver alcohol, including grocery stores and small farm wine convenience stores, and allows deliveries to be made by employees of the permit holder or by independent contractors with a separate third-party delivery permit. To obtain a third-party delivery permit, an applicant must pay a $500 annual fee and submit a training program that covers identifying underage or intoxicated individuals and recognizing valid identification. Delivery drivers must be 21 years or older, have a valid driver's license, and have no felony convictions. The bill establishes strict rules for deliveries, including that alcohol can only be delivered to individuals 21 or older who can provide valid ID, within wet counties or adjoining wet counties, and with specific verification procedures. Retailers are largely protected from liability for actions taken by third-party delivery permit holders, and the Alcoholic Beverage Control Division has the authority to enforce the new regulations through administrative proceedings, including the ability to fine, suspend, or revoke permits for violations.
