This bill removes state preemption provisions related to local regulation of hoisting equipment, which previously prohibited counties, municipalities, and other political subdivisions from creating their own rules about construction equipment like power-operated cranes, derricks, hoists, elevators, and conveyors. Under the previous law, local governments were forbidden from establishing local regulations about such equipment that went beyond federal Occupational Safety and Health Administration (OSHA) standards, including rules related to hurricane preparedness or public safety. By removing these preemption provisions, the bill will allow local governments more flexibility to create their own regulations regarding hoisting equipment used in construction, demolition, and excavation work. The bill maintains existing exceptions for elevator regulation under chapter 399 and airspace height restrictions under chapter 333. The changes will take effect on July 1, 2025, giving local governments and stakeholders time to prepare for potential new local regulations.
