AI Summary

This bill amends the Criminal Code of 2012 to create a new offense called domestic assault. The bill defines domestic assault as an act where a person, without lawful authority, knowingly engages in conduct that places a family or household member (as defined in another section of criminal procedure law) in reasonable fear of great bodily harm, permanent disability, or disfigurement. If a defendant is arrested for domestic assault and released pending trial, the court must mandate that the defendant have no contact or communication with the victim and stay away from the victim's residence for a minimum of 72 consecutive hours. The offense is classified as a Class A misdemeanor, which typically carries potential penalties such as up to one year in jail and/or a fine. By creating this specific statute, the bill aims to provide clearer legal protections for victims of domestic violence by establishing precise conditions and consequences for acts that threaten the safety of family or household members.
