This bill amends Minnesota state law to require public institutions like correctional facilities, jails, and other state or county facilities to take specific actions when they house suspected undocumented individuals. The bill mandates that when a person convicted of a felony or committed due to mental health concerns is in the custody of a publicly funded institution, the chief executive officer, sheriff, or other administrative officer must investigate the individual's nationality. If the person is determined to be an undocumented alien, the officer is required to immediately notify the United States Immigration and Customs Enforcement (ICE) district officer with detailed information, including the date of conviction, the crime committed, the length of commitment, the person's country of citizenship, and the date and port of last entry into the United States. Additionally, by September 1, 2025, these institutions must conduct a comprehensive review of the immigration status of all individuals serving felony sentences in their custody, with the same reporting requirements if an undocumented individual is identified. The bill removes previous language related to mentally ill persons and standardizes the reporting process for institutions housing individuals who may be subject to immigration enforcement.
