This bill requires the New York State Senate finance committee and the assembly ways and means committee to prepare detailed fiscal impact statements for certain "qualifying bills" before they can be discharged from consideration. A qualifying bill is defined as legislation that establishes or eliminates a state program, significantly changes program services, or results in revenue or expense changes for the state or political subdivisions. The fiscal impact statements must clearly detail estimated costs or savings for the state and affected political subdivisions over the next three fiscal years, including the sources of those estimates. The committees can calculate these impacts by examining individual political subdivisions, aggregates of subdivisions, representative subdivisions with similar characteristics, or other appropriate groupings. The fiscal impacts can be reported in monetary units, services, personnel, equipment, or other measurable units. Importantly, any inaccuracies in the estimates will not invalidate the bill. Certain types of bills are exempt from this requirement, such as those subject to existing legislative provisions, those with special home rule requests, bills providing only discretionary authority, and certain bills submitted under state finance law. The bill will take effect on the first day of January following its enactment.
