This bill introduces new regulations to prevent medical professionals from soliciting patients immediately after an accident or injury. Specifically, the bill prohibits medical professionals, their employees, agents, or contractors from soliciting individuals who have been injured in an accident, disaster, or similar event within 30 days of the incident, with exceptions for those who have a pre-existing family or professional relationship with the individual. The bill defines "solicitation" broadly to include in-person, telephonic, text message, internet, and electronic direct message communications. Violations are classified as a Class D felony, and any agreements for healthcare services resulting from such solicitation are deemed invalid. Patients, persons, or insurance companies who paid for services under such circumstances can receive a full refund and reasonable attorney's fees. The bill allows for private legal action, with potential damages of either $500 or twice the pecuniary loss, whichever is greater. Importantly, the legislation does not prohibit targeted advertising through mail, radio, or television, provided such advertising is not coercive, misleading, or harassing. The bill aims to protect individuals from aggressive medical solicitation in the aftermath of traumatic events.
