This bill revises rules for elected public officers seeking to run for another elective office. Under the new provisions, an elected public officer would be required to resign from their current office before filing nomination papers for another elected position, with some important exceptions. The resignation requirement does not apply if the current term of office will expire less than 12 months before the nomination filing deadline. The bill also specifically exempts certain judicial officers (Supreme Court justices, Court of Appeals judges, district judges, justices of the peace, and municipal judges) and individuals who are already legally authorized to hold multiple elected offices, such as those serving in special districts like irrigation or fire protection districts. If an elected official does not voluntarily resign, they will be automatically deemed to have resigned effective on the nomination filing deadline. The bill will take effect for elected public officers on or after October 1, 2025, providing a clear timeline for implementation of these new resignation requirements.
