The Attorney General will review the proposed negotiations, considering factors like market power, potential anticompetitive effects, and impact on consumer care. If approved, dental providers can jointly negotiate on topics such as medical necessity definitions, utilization management, clinical guidelines, patient referral standards, quality assurance programs, and administrative procedures, but cannot negotiate fee-related matters like payment amounts. The negotiations must be voluntary, and providers can select a representative to negotiate on their behalf. After reaching a proposed agreement, the joint negotiation representative must submit the terms to the Attorney General for further review, which will assess fairness, potential consumer benefits, and risks of harm. The bill explicitly does not apply to dental benefit plans for medical assistance recipients and cannot be used to limit dental services or violate federal antitrust laws.
