This bill allows county commissioners in New Mexico to petition the Cannabis Control Division of the Regulation and Licensing Department to pause the issuance of new cannabis producer licenses in their county for a two-year period. The county board must first vote to submit the petition and then publish a public notice and notify the division. The petition can cover commercial cannabis production, medical cannabis production, or both. After receiving the petition, the division must make a decision within ten days, either approving or denying the request. If approved, the division will not issue new cannabis production licenses in that county for two years. If denied, the division must provide its reasoning. Importantly, the county also has the option to request an early end to the moratorium if they determine it is no longer necessary. This bill provides local governments with more control over cannabis licensing in their jurisdictions, allowing them to temporarily halt new cannabis producer licenses based on local needs or concerns.
