This bill modifies the existing Maryland law regarding land use and zoning for municipalities that have annexed new territory. Currently, municipalities are restricted from significantly changing the land use or density of annexed areas for 5 years without county approval. The bill replaces references to specific county "zoning classifications" with broader "land use recommendations" from the county or municipal comprehensive plan. Under the new provisions, a municipality can develop annexed land without county approval if the changes do not exceed 50% difference in density or substantially change the land use from the original comprehensive plan recommendations. If the county expressly approves, the municipality can place the annexed land in a zoning classification that allows different land uses or densities than originally specified in the comprehensive plan. The bill aims to provide more flexibility for municipalities in developing newly annexed lands while still maintaining some county oversight. The changes will take effect on October 1, 2025.
