This bill modifies Texas Election Code Section 64.009(a) to expand the circumstances under which voters can request a ballot at the polling place entrance or curb. Currently, voters could only receive a ballot outside the polling place if they were physically unable to enter without assistance or risked injuring their health. The proposed changes would now allow voters to request an outside ballot in three scenarios: (1) if they are physically unable to enter the polling place without personal assistance or risk of health injury (as before), (2) if they have legal custody of a child under 12 years old and entering the polling place would require leaving the child without adequate supervision, or (3) if they are the primary caretaker of a person who cannot care for themselves and entering the polling place would leave that person without adequate supervision. The bill is set to take effect on September 1, 2025, and aims to provide more flexibility for voters with caregiving responsibilities to participate in the election process.
