This Study Bill establishes a defense against civil lawsuits related to the use of pesticides that have been registered by the United States Environmental Protection Agency (EPA) under the federal Insecticide, Fungicide, and Rodenticide Act (often referred to as the federal Act). Essentially, if a pesticide is registered with the EPA, the bill states that its label is considered adequate for warning about health and safety risks if it meets any of three conditions: it was approved by the EPA, it aligns with the EPA's latest assessment of human health impacts from the pesticide, or it is consistent with the EPA's classification of the pesticide's potential to cause cancer. If the label meets any of these criteria, it will satisfy all state-level requirements for warnings and labeling, as well as any common law obligations to warn users about potential dangers.
