This bill amends Tennessee's existing law on unlawful images by expanding the definition of what constitutes an unlawful image. Specifically, the legislation adds a new provision that makes it an offense to distribute an image of an identifiable person's intimate parts or sexually explicit conduct if that image was created or modified using digital technologies like computer software, artificial intelligence, or other digital editing tools. The bill introduces a legal mechanism to address the growing problem of digitally manipulated or artificially generated explicit images, often referred to as "deepfakes," which can be used to harass, humiliate, or cause emotional distress to the person depicted. The law will apply when the image was created or modified without the consent of the person shown and with the intent to cause emotional harm. The amendment to Tennessee Code Annotated, Section 39-17-318, will take effect on July 1, 2025, giving time for legal professionals and law enforcement to prepare for the new provisions.
