This bill requires new passenger motor vehicles weighing less than 10,000 pounds, manufactured one year or more after the National Highway Traffic Safety Administration (NHTSA) establishes final regulations, to be equipped with a rear occupant alert system. The system must be designed to alert the vehicle operator to check rear-designated seating positions after the vehicle's engine or motor is deactivated. Specifically, the bill applies to motor vehicles with rear seats that can be registered in New York State. The purpose of this legislation is to help prevent incidents where children or pets might be inadvertently left in the back seat of a vehicle. The bill includes a severability clause, meaning that if any part of the law is found invalid, the rest of the law remains in effect. Additionally, the bill includes provisions that would cause it to be automatically repealed if it renders New York ineligible for federal funds or is determined to be non-compliant with federal law by a court of competent jurisdiction.
