This bill creates a voluntary registry for non-road diesel engines in Utah, which are defined as diesel-powered internal combustion engines not used for transportation on highways or solely for competition. The registry will help track and manage diesel engines in designated nonattainment counties (including Box Elder, Cache, Davis, Salt Lake, Tooele, Utah, and Weber Counties), which are areas that do not meet national air quality standards for particulate matter. Owners of non-road diesel engines can voluntarily register their engines by submitting an application with details such as ownership evidence, operating county, engine characteristics, and paying a registration fee of up to $50. The Division of Air Quality will establish and manage this registry, and registration is a prerequisite for being eligible for future replacement incentives (such as grants or rebates to encourage engine upgrades). Registration fees will be deposited into the Environmental Mitigation and Response Fund, and the division may use these funds to cover administrative costs. The bill includes provisions for the division to create administrative rules to implement the registry and sets the effective date as May 7, 2025.
