This bill expands Nevada's existing laws related to pornography involving minors to explicitly include artificial intelligence-generated content. Specifically, the bill defines an "artificial intelligence-generated minor" as a fictional human created through AI technology that appears to be a minor. The legislation makes it a category B felony to prepare, advertise, or distribute materials that include: (1) digitally altered images of actual minors engaging in sexual conduct, or (2) obscene depictions of AI-generated minors simulating sexual conduct. The bill also makes possessing such materials a criminal offense, with penalties ranging from category B to category A felonies depending on the circumstances. Additionally, the bill updates numerous existing Nevada Revised Statutes to include references to "artificial intelligence-generated minors" in contexts such as sex offender registration, background checks for certain professions working with children, and criminal record sealing provisions. The changes are designed to ensure that emerging AI technologies cannot be used to create sexually explicit content involving minors, treating AI-generated images with the same legal seriousness as images of real children. The bill is set to take effect on July 1, 2025, giving time for legal systems and stakeholders to prepare for the new regulations.
