This bill amends the School Code to expand the State Superintendent of Education's authority regarding educator license investigations. Specifically, the bill allows the State Superintendent to notify a license holder's current or most recent employer about an ongoing investigation if the investigation involves an alleged act of misconduct that could potentially threaten student safety. The notification can be made to employers such as public schools, school districts, charter schools, special education cooperatives, nonpublic schools, nonpublic special education facilities, or public school residential facilities. The types of misconduct that would trigger such notification include serious physical injury, sexual misconduct, or certain sex offenses. This provision aims to enhance transparency and protect student safety by enabling employers to be aware of potential risks associated with an educator under investigation, while maintaining the confidentiality of the investigative process. The bill adds a new subsection (e-5) to the existing law to codify this notification mechanism, giving the State Superintendent discretion to inform relevant employers about ongoing investigations that might pose a risk to students.
